Construction Disputes

GH&R’s Construction Law Group represents project developers, owners, contractors, subcontractors, suppliers and design professionals in connection with construction-related claims and disputes.  We represent clients in matters involving all manner of projects and structures, and we investigate and work with expert witnesses regarding a wide variety of construction and design issues.

Importantly, we understand that construction claims are often best resolved through the use of alternative dispute resolution methods, such as mediation and arbitration.  We have the experience to effectively handle matters in these alternative forums.  We also understand that insurance coverage frequently plays a critical role in construction claim dispute resolution.  We therefore often investigate and pursue insurance coverage for our clients as part of a winning strategy to resolve construction-related claims on favorable terms.  When litigation does become necessary, our group’s highly skilled litigation attorneys can handle disputes in state or federal court.  Some examples of relevant work include:

  • Defended architect in two personal injury actions resulting in a dismissal in one case and nuisance settlement in the other.
  • Defended local airport authority in a multi-million dollar claim pursued by a national contractor that resulted in no payment to the contractor.
  • Negotiated numerous multi-million dollar construction contracts on behalf of owners, design professionals, contractors, subcontractors, construction managers and design firms.
  • Represented owners, design professionals, contractors and subcontractors as well as other project participants in numerous arbitrations, mediations and other alternative dispute resolution forums.
  • Successfully represented contractor in multi-million dollar, multi-jurisdictional dispute involving owner, developer, architect and surety in which contractor recovered a significant sum of money and was relieved of nearly $5 million in indemnity obligations to its surety.
  • Successfully represented environmental remediation subcontractor in AAA arbitration with prime contractor resulting in dismissal of contractor’s $10 million claim and award to client in excess of $2 million.
